What is Assault Crime?

Assault also referred to as attempted battery is an intentional, willful, unlawful act of attempting or threatening to forcefully or violently cause physical harm or injury to another individual, whether successful or not, and when the intended victim is aware of the threat and therefore causes a reasonable apprehension of imminent danger in the intended victim.

There must also exist the apparent present ability to carry out the act, if it is not prevented.

Assault can be both a criminal and a civil wrong, remedied by criminal punishment and/or civil damages.
